Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Dashoo application ("App") or visiting our website at dashoo.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and GW Digital ("we", "us", "our").

2. Eligibility

You must be at least 17 years old to use Dashoo. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Safety and Driver Responsibility

• You are solely responsible for complying with all applicable traffic laws in your jurisdiction.
• You acknowledge that dashcam use may be restricted or regulated in certain jurisdictions. It is your responsibility to verify legality in your area.
• GW Digital accepts no liability for accidents, fines, penalties, or damages resulting from distracted driving or unsafe use of this App.
• You must comply with all applicable laws regarding recording audio and video, including consent requirements in your jurisdiction.

4. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

5.1 Subscription Tiers

• Free: Core recording features with advertisements.
• Basic (Ad-Free): All features without advertisements. Monthly or annual billing.
• Pro: Ad-free experience plus cloud storage. Monthly or annual billing.

5.2 Billing

• Subscriptions are processed through Apple App Store or Google Play Store.
• Payment is charged to your store account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Prices may change. We will provide reasonable notice of price increases.

5.3 Cancellation and Refunds

• You may cancel your subscription at any time through your device's store settings.
• Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple or Google in accordance with their respective refund policies.
• EU/UK consumers: You have a 14-day cooling-off period for digital purchases, unless you have consented to immediate performance and acknowledged loss of withdrawal right.

6. Your Content and Data

• Ownership: You retain full ownership of all video recordings and data you create using the App.
• Local storage: Recordings are stored on your device by default. We do not access them.
• Cloud storage (Pro): If you enable cloud sync, your recordings are encrypted and stored securely. We do not view, analyse, or share your recordings.
• Deletion: You may delete your recordings and account data at any time through the App.

7. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Record individuals without their knowledge where required by law (e.g. two-party consent jurisdictions)
• Use recordings to harass, stalk, or intimidate others
• Reverse-engineer, decompile, or disassemble the App
• Attempt to circumvent subscription restrictions or payment mechanisms
• Use the App in a manner that could damage, disable, or impair our services

8. Intellectual Property

The App, including its design, code, features, and branding, is owned by GW Digital and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Provision

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Guarantee of Recording

• We do not guarantee the App will record every event or that recordings will be uninterrupted.
• We do not guarantee that footage will be admissible as evidence in legal proceedings.
• We are not liable for corrupted files, recording failures, or data loss.

9.3 Limitation of Liability

To the maximum extent permitted by applicable law, GW Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the App.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Note for EU/UK/Australian consumers: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Your statutory rights are not affected.

10. Indemnification

You agree to indemnify and hold harmless GW Digital from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Termination

• We may suspend or terminate your access if you violate these Terms.
• You may stop using the App and delete your account at any time.
• Upon termination, your licence to use the App ceases. Locally stored recordings remain on your device.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via the App or email at least 30 days before taking effect. Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the App.

13. Governing Law and Disputes

• UK/EU users: These Terms are governed by the laws of England and Wales. You may bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory consumer rights.
• US users: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
• Australian users: These Terms are governed by the laws of the Commonwealth of Australia. Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the Australian Consumer Law.
• Canadian users: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
• New Zealand users: These Terms are governed by the laws of New Zealand. Your rights under the Consumer Guarantees Act 1993 are not affected.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and GW Digital regarding the App.
